Zarzaur Law’s monthly “Legal Graffiti” event raised a record amount in the month of February for Alzheimers Association of Northwest Florida.

A new record for a very worthy cause!

“We are so honored to be able to give back so generously every month to non-profits who do so much for our community – and in February we reached a new record because of YOUR donations, Pensacola. Thank you. Together, we are making a difference in our wonderful city!” said Joe Zarzaur.

The March event also raised the highest amount the firm has given to Gulf Coast Kid’s House to date.

U.S. Pedestrian Deaths Highest in Three Decades.

A recent study has found that pedestrian deaths are at a 30 year high. The study published by the Governor’s Highway Association noted that there were over 6,200 pedestrian deaths in 2018 which was the highest amount of such deaths since 1990. The study focused only on those injuries or deaths that were the result of a car impacting a pedestrian.

Distracted Driving and Pedestrian Deaths

This is no surprise to Zarzaur Law. We have noticed in the last several years that more and more pedestrians are being seriously injured or killed at higher rate than recent past. We have noticed that the cause of these collisions with pedestrians, in many cases, is distracted driving. The association study also found that the uptick in pedestrian deaths were, in part, due to increased smartphone usage.

Interestingly, this uptick has been on the rise since 2009 reaching this highest amount in 2018. This increase occurred despite the fact that traffic related deaths for other reasons had decreased. The study attributed this increased in pedestrians deaths to more nighttime crossings, more distracted driving, and more alcohol/drug impairment by both drivers and pedestrians. 90% of the death rate increase was related to nighttime collisions.

This increase in pedestrian death rate has been noted to be as high was 35% more than in 1990. Here at Zarzaur Law, we are committed to representing this victims of careless drivers and have a long history of representing pedestrians (or their survivors) who are hit by distracted drivers.

These cases usually have significant issues related to fault and it is important that our legal investigation occurs soon after the event so that we can insure collection of all relevant evidence which can assist in proving who is at fault for the collision.

Zarzaur Law Represents Family of Pedestrian Killed

The firm recently represented a family of a pedestrian struck and killed on Gulf Beach Highway. The facts of this case were that our client was attempting to cross the Gulf Beach Highway in an area that was not well lit. As she crossed the highway, she stopped in the middle turn lane. At the same time, the defendant driver was headed towards Pensacola to meet friends at a downtown club. The impact with this pedestrian was so significant that she suffered fatal injuries and was rendered brain dead within hours of the impact. The at fault driver claimed that our client “ran out in front of her” and had a “death wish”. We took on the case and started to find that this story did not line up with the physical evidence. Our firm utilized our investigation team to collect evidence at the scene and to document the scene both during the day and at night to simulate the conditions.

Zarzaur Law Investigation Proves at Fault Driver’s Responsibility

We then started to focus on the at fault driver and during litigation were able to discover that she was actually on several different prescription medications in addition to being under the influence of alcohol. At every step, the at fault driver took no responsibility and maintained that our client jumped out in front of her wanted to kill her self. However, the physical evidence and evidence of drug and alcohol use was too much for the at fault driver to handle. Ultimately, the at fault driver settled this wrongful death case for a confidential sum. While this settlement will do little to make up for the void created in this family, the fact that this driver had to account for her actions made this family whole and allowed some additional closure.

Painting of New Community Mural on Zarzaur Law Building to Begin March 15

PENSACOLA, Fla. (Mar. 6, 2019) — Zarzaur Law, P.A., a personal injury law firm based out of Pensacola, Florida, in partnership with local artists Veronique Zayas and Somi Choi, will begin the painting of the new mural that is a part of the “Call for a Wall” project. Zayas and Choi sent out a “Call for a Wall” in hopes of collaborating with a local Downtown Pensacola business that had an outside wall that could provide the canvas for this mural. Zarzaur Law offered up the North facing wall on the outside of its building at 100 South Palafox, located at the corner of Romana and Palafox Streets in Downtown Pensacola.

Painting of this mural on The Zarzaur Building will commence on Friday, March 15, at 9:30pm at the conclusion of Zarzaur Law’s “Legal Graffiti” fundraiser during the March Gallery Night event. The artists will be painting throughout the weekend with the final mural ready for photos, selfies and documentation on Monday, March 18.

“Imagine driving down Palafox and being greeted with a large-scale, bold and bright Pensacola-focused saying,” said Veronique Zayas, “Something that is shared repeatedly across Instagram and other social channels – that local residents and tourists can snap a shot in front of.”

This locally focused mural will be a positive “point of interest” and a destination within Downtown Pensacola for both visitors and locals alike. It is planned to be on display for up to 12 months.

Zarzaur Law Maritime De Luna Youth Duathlon Provides a Real Multi-Sport Race Experience for Kids!

The Zarzaur Law Maritime De Luna Youth Duathlon will be on SUNDAY March 10th!  

This race has over 200 participants, from ages 6-15 years old.

The event is held at the  Vince J. Whibbs, Sr. Community Maritime Park in Pensacola, Florida. The event features a full duathlon experience for children from 6 to 15 years old while friends and family cheer them on. With a fully supported event on a closed course, safety and encouragement from volunteers complement the excitement of children becoming multisport athletes.

 This is a fully timed event and each athlete receives a custom medal and t-shirt for completing the race.  Custom age group awards are given for 1st, 2nd, and 3rd in each age group.  

What is a Duathlon?

A duathlon is a competition that is composed of running and biking. The usual format for a duathlon is run-bike-run, meaning you start with a run, then transition to the bike, then transition back to running again. Your time starts when you start the race, and finishes when you cross the finish line.

About Tri Gulf Coast Youth Multi-sport – 
Since 2013, Tri Gulf Coast Triathlon Club has put on two youth multisport events.  We pride ourselves in providing premiere youth events that have exciting race venues.  Our attention to detail make for a memorable experience for athletes between 6yrs and 15 years old.

The Zarzaur Law Maritime de Luna Du Youth Duathlon is the first of two events in the TriGulfCoast Youth Multisport Series. The De Luna Du Youth Duathlon is held in early March at Pensacola’s Community Maritime Park. The race offers a scenic run-bike-run course for kids ages 6 to 15 (as of December 31 in the year of the event).

The Zarzaur Law Sea Turtle Youth Triathlon is held on the beautiful Gulf of Mexico in Pensacola Beach, Florida. The event features a full triathlon experience for children from 7 to 15 years old while friends and family cheer them on. With a fully supported event on a closed course, safety and encouragement from volunteers complement the excitement of children becoming triathletes.

​The Dolphin Dip ‘N Dash is new for 2019. This race will take place at Shoreline Park in Gulf Breeze, Florida.  This event is a swim and run (aquathlon) experience for children from ages 6 to 15 years old and will consist of 3 distances based on age. The swim portion will take place in the calm and shallow waters of Santa Rosa Sound, while the run portion is an out and back course that takes athletes on a shady path within Shoreline Park.

In 2016 TriGulf Coast joined forces with Pillars For Promise to attain 501c3 status as a non-profit organization.  Pillars for Promise is a community 501c3 that allows smaller organizations be represented and benefit from the non-profit status.  We are grateful to be a part of this program.

Perkins v. Tinsley – Thief Landlord Found Liable for Punitive Damages.

My firm and I are not really in the business of working on all personal injury cases, just the ones where we can really make a difference. Making a difference not only in the lives of our clients who are forever changed in most every way, but also making a difference in the defendant. Whether the defendant be a careless driver, negligent physician, or even a greedy business putting profits before their product or service. I also think, can we make a difference for the betterment of our community even if its one case at a time? If the answer is yes, then I want to be in that case, working for that client making sure we change their lives for the better, impact our community and all the while making our own lives more fulfilling by just knowing we helped.

Recently, my firm was asked for help with a bully landlord. Obviously, this is not our firm’s main mission since there was no injury involved. But as I started to listen to this client, it became clear to me that for decades this landlord had been stealing money from his tenants and ignoring Florida law. He was using threatening letters to intimidate tenants for years and rarely, if ever, refunding security deposits. When we started doing investigation into this person we discovered tenants for years and years were being treated exactly the same way. I discovered a true menace to our community and despite the fact that I might lose more money than I would make, I decided to get behind this case and stop this jerk.

Here  is  his picture, his name is Paul Tinsley. This guy, over the years, has basically taken nearly every one of his tenants security deposits and just considered them additional rent. For nearly 20 years, over the course of nearly 30 rental properties, he has chosen to not use the legal Florida lease agreement but instead used his own version of a lease, an illegal lease in Florida. The reason he chose this lease was that it omitted all of the required language about how a landlord would handle security deposits.

He and his wife basically engaged in fraud and civil theft, making up reasons to retain deposits from all types of tenants, most of which could not afford them to do these things. Anyway, his calculation was that if he threatened to sue people when they left, which he did nearly every time, they would be scared to come after him for their deposits. He calculated that none of these folks who had less resources than him would pay the money to come after him for their deposits. So, he took and took year after year. Then we decided it was time to end this bully practice.

So we sued him in Escambia County Circuit Court. We alleged fraud and civil theft and started taking depositions. He dismissed this as a case about one security deposit and not worth his time or the court’s time. He was correct that at issue was one security deposit of around three thousand dollars. What Bully Tinsley didn’t factor into his calculation was the fact that the law in Florida actually permits us to ask the court to permit punitive damages for cases where the defendant acts intentionally or wantonly. So, after we got security sworn testimony from several other witnesses that said he nearly always kept deposits and refused to follow Florida law with his leases, the judge allowed us to ask for punitive damages.

We took him all the way through trial and received a verdict in the amount of $41,000.00. This included nearly $25,000.00 in punitive damages calculated to deter this bully from being a thief in the future. Perhaps the even more comforting is that fact that the Court is also considering awarding lawyer fees to my client which will be an extremely costly figure for this Sleezebag landlord. Of course, he wrote his own appeal that is currently pending with the First District Court of Appeal.
