PENSACOLA, Fla. (SEPT. 18, 2023) — Following a nine-day jury trial held in Escambia County Circuit Court before Judge J.J. Frydrychowicz, Baptist Health Care and Tony Yates, as personal representative for the estate of Diane Yates, reached a settlement. The settlement terms are confidential, and the agreement was reached just hours prior to closing arguments. The settlement was not intended to imply fault for either party, as they reached a mutually satisfactory resolution just prior to the conclusion of the trial.
The plaintiff was represented by Attorney Joe Zarzaur of Zarzaur Law, P.A., along with Attorney Brent Bradley. Baptist Health Care was represented by Attorneys Tom Gonzalez and Jena Wise of the Beggs & Lane law firm.
The case arose out of the postoperative care Diane Yates received from nurse Michelle Morrison. The plaintiff alleged that Nurse Morrison negligently administered two incompatible medications, which caused a fatal reaction. Baptist denied the allegations and contended that the nurse did not administer the medications together and that Mrs. Yates died from complications from the surgery for which she was in the hospital.
