Is tailgating against the law in Florida?

Yes, tailgating is indeed illegal in Florida under Florida Statute 316.0895. This statute prohibits drivers from following other vehicles closer than what is deemed “reasonable and prudent,” considering factors such as speed, traffic conditions, road conditions, and weather. Violating this law constitutes a noncriminal traffic infraction, classified as a moving violation.

As a guideline, it is recommended to maintain a distance of at least two car lengths between vehicles. Additionally, for trucks or trailers, it is unlawful for drivers to follow within 300 feet of such motor vehicles. This regulation aims to promote safer driving practices and reduce the risk of rear-end collisions caused by tailgating.
