Board Recertification in Civil Trial Law By the Florida BarAttorneys Joe Zarzaur and Steve Bolton have received their board recertification in Civil Trial Law by the Florida Bar.  Board certification recognizes attorneys’ special knowledge, skills and proficiency in various areas of law and professionalism and ethics in practice. Certification is the highest level of evaluation by the Florida Bar of the competency and experience of attorneys and helps consumers identify specialists in various areas of law.

Mr. Bolton originally earned Board Certification in 1991 and Mr. Zarzaur originally earned Board Certification in 2006. Both Zarzaur and Bolton have achieved recertification every five years since originally achieving Board Certification as Civil Trial Specialists.

The Florida Bar Board Certification – What Is It About?

Board certification is a voluntary program for lawyers. Approved by The Florida Supreme Court and established in 1982 board certification is administered by The Florida Bar to help the public choose a lawyer. Certification is the highest level of evaluation by The Florida Bar of the competency and experience of attorneys in the areas of law approved for certification.

The Florida Bar evaluates all certified lawyers for experience and expertise in a particular area of law as well as for professionalism and peer acknowledgement. After successfully undergoing the certification process and becoming board certified, a board certified lawyer may say that they have been “Evaluated for Professionalism and Tested for Expertise.”

The Board of Legal Specialization and Education (BLSE) of The Florida Bar governs the rules and policies for each of the certification areas and oversees the committees that implement each area’s standards. A lawyer must be a member in good standing of the Florida Bar and meet the area’s prescribed standards to become board certified. Standards for each area vary but each area maintains common minimum standards including:

– A minimum of five years in law practice.
– Substantial involvement in the field of law for which certification is sought.
– A passing grade on the examination required of all initial applicants.
– Satisfactory peer review assessment of competence in the specialty field as well as character, ethics and professionalism in the practice of law.
– Satisfaction of the certification area’s continuing legal education requirements.

Board certification is valid for five years, during which time the attorney must continue to practice law and attend Florida Bar approved continuing education courses. To be re-certified lawyers must meet requirements similar to those for initial certification.

Why Is Board Certification Important? 

Board certification establishes an independent measure of competence, professionalism and peer acknowledgement which helps clients and fellow lawyers set expectations for professional abilities. This level of verifiable expertise can help both prospective clients and counsel seeking to refer legal matters and can help lawyers grow their practice with matters in which they can best utilize their expertise. 

What Does All Of This Mean To Potential Clients?

Only about one percent of Florida lawyers are board certified and it is the only designation that Florida lawyers can utilize when comparing themselves to other lawyers.

January is Move Over month in Florida, and the Florida Department of Highway Safety and Motor Vehicles (FLHSMV) and its division of the Florida Highway Patrol (FHP) are reminding motorists to Move Over for emergency or service vehicles stopped along the roadway.

FLHSMV and FHP are partnering with the Florida Department of Transportation, Florida Police Chiefs Association, Florida Sheriffs Association, and AAA – The Auto Club Group to drive the Move Over message home and ensure all law enforcement, first responders, service and utility workers, and Road Rangers Arrive Alive in 2021.


Preliminarily in 2020, there were 159 crashes and over 12,000 citations issued for motorists failing to move over in Florida.


“Each move-over related crash or citation is not simply a statistic, it represents a first responder or service professional – all with family and loved ones – who were carelessly put in danger while trying to serve and protect Floridians along the roadway,” said FLHSMV Executive Director, Terry L. Rhodes. “Please, give law enforcement, first responders, and service and utility professionals space to safely do their jobs by moving over or slowing down – it’s the law, and it could save a life.”

The Move Over Law

The Move Over Law was added to section 316.126, Florida Statutes, in 2002. The statute, which was originally introduced in 1971, requires motorists to move or yield the right-of-way to emergency vehicles and in 2014, utility and sanitation vehicles were added to the Move Over Law. The Move Over Law states that drivers must move over as soon as it is safe to do so for any authorized law enforcement, emergency, or service vehicles displaying any visible signals while stopped on the roadside, including Road Rangers, sanitation vehicles, and tow trucks.

“Florida’s Move Over law helps provide a safe work environment for first responders and everyone who delivers critical services along our roadways,” said Colonel Gene Spaulding, Director of the Florida Highway Patrol. “Please do your part while traveling our roadways and abide by the Move Over law to help protect our emergency personnel and their loved ones.”

What If You Can’t Move Over?

When motorists cannot vacate the lane closest to the emergency or service vehicle, they must slow to a speed that is 20 miles per hour less than the posted speed limit. Failure to yield or move over puts law enforcement officers, emergency first responders and public service workers in danger while they are on the job protecting and serving the citizens and visitors of Florida.

“Our law enforcement, first responder, service/utility worker, as well as Road Ranger partners, work on the side of the road in service to all of us,” said Florida Department of Transportation Secretary Kevin J. Thibault, P.E. “Do your part to keep them safe. Slow down or move over so everyone can arrive home safely to their loved ones.”

“Our deputy sheriffs are on the highways day and night providing protection for our citizens that we so honorably serve. While traveling, if you see a first responder vehicle stopped on the shoulder of the roadway please move over to help protect those who protect you. On behalf of our Florida Sheriffs, I fully endorse the Department of Highway Safety and Motor Vehicles’ Move Over Campaign,” stated Sheriff Bobby Schultz President of the Florida Sheriffs Association.

Safety First For You And Emergency Responders

“Every driver has a part to play in keeping law enforcement and other first responders safe. When you see law enforcement or another vehicle with flashing lights, please slow down, move over, and give them space to stay safe,” said Chief Jeff Pearson, Satellite Beach Police Department and President of the Florida Police Chiefs Association. “And when you safely move over, you are signaling to the drivers behind you that they should follow your lead. By moving over, you are helping our law enforcement officers return home safely.”

“Our heroes on the roadside need your help,” said Matt Nasworthy, Florida Public Affairs Director, AAA – The Auto Club Group. “They can’t save our lives if we don’t protect theirs. Please do your part to Slow Down and Move Over.”

To Comply With The Move Over Law Drivers Must:

Multi-Lane Roadway:

  • Vacate the lane closest to the stationary emergency vehicle, sanitation vehicle, utility service vehicle, Road Ranger or wrecker and always signal the intention to change lanes.
  • Slow down to a speed of 20 mph below the posted speed limit if a driver cannot move over safely.
  • Be prepared to allow those who are attempting to move over into the next lane.

Two-Lane Roadway:

  • Slow down to a speed of 20 mph below the posted speed limit.
  • Travel at 5 mph if the speed limit is 20 mph or less.

While being fast is a great contributing factor and several of our athletes are incredibly fast, that, in and of itself, is not what it takes. The Zarzaur Law Triathlon Team is looking for triathletes that want to live lifestyles of health, fitness and truly love endurance sports. We’re looking for people who try to give a word of encouragement to others who are on the course, road, and water. And lastly, race to the absolute best of your ability and have the drive to be the best YOU can be but, congratulate others even when things don’t go according to plan on race day. 

Philanthropic and Community Focused:

The Zarzaur Law Tri Team focuses extracurricular time on community events and charities. In addition to volunteering at designated events, the Gavel Team has adopted Favor House and the Gulf Coast Kids House as the two charities to support and represent. This includes some required events and fundraisers for these non-profit organizations each season.

This is a great destination sprint triathlon is for seasoned triathletes and new ones alike. This is a great destination race for the entire family.  This USAT sanctioned sprint distance triathlon features a flat and fast course.  The 600 yd swim is along the pristine shores of the Gulf of Mexico.  The bike is an out and back that traverses along the shores of the Pensacola Beach and the 5 kilometer run takes you through an idyllic beach neighborhood.

Santa Rosa Island Triathlon is produced by Give It A Tri, Inc. (“GIAT”) which manages and executes multi-sport race events. GIAT will concentrate its outreach to youth organizations that promote athletics in the area of swimming, biking, running, and multi-sport but not limited to these categories of organizations.

History of the Race

The first race was on October 12, 1996.  Ann said “I hoped for 250 athletes and we had 450!” – this was just the beginning of many years of success as the race grew to over 1,300 athletes..  Despite some tough weather years the event continued to grow and triathletes from all over the United States flocked to Pensacola Beach to compete in one of “America’s 100 must do races”.

From its inception, a large portion of the profits have been donated to many projects on Pensacola Beach which included dune restoration, benches for trolley stops, bike racks around the island, playground equipment for the Beach School, bikes for the Beach Sheriff Department, surfboards and life preservers for the lifeguards, and sponsoring youth triathletes to attend USA Triathlon Training Camp as well as hosting a week-long triathlon program for under-privileged youth within the community.  The generous donations continue today to programs that support youth and adult athletic programs in the community.

Zarzaur Law Files Lawsuits Over Three Mile Bridge Damage

PENSACOLA, Fla. (November 25, 2020) — Zarzaur Law, P.A. filed lawsuits for clients, against Skanska USA Civil Southeast, Inc. and Eisman and Russo, Inc., for negligence associated with the collapse of the Three Mile Bridge during Hurricane Sally.

Prior to Hurricane Sally’s arrival, the unfinished Three Mile Bridge was operational and had two lanes of traffic going each way. Despite their knowledge of Hurricane Sally’s approach and destructive potential, Skanska and their contractors made the conscious decision to keep working on the bridge instead of securing their equipment, in violation of their contract with the Florida Department of Transportation. As a result, dozens of Skanska’s floating work platforms broke free of their restraints and moved uncontrollably around Pensacola Bay. Some of these platforms crashed repeatedly the Three Mile Bridge, causing a collapse which has rendered the bridge unsuitable for traffic.

Among several others, Zarzaur Law represents The Dock, one of the largest and most recognizable entertainment venues on Pensacola Beach. Prior to the collapse of the Three Mile Bridge, The Dock enjoyed a steady stream of patrons, including many tourists and residents of the greater Pensacola area.

Until the Defendants’ negligence caused the collapse of multiple sections of the Three Mile Bridge, The Dock was a thriving, locally owned bar and entertainment venue. However, the preventable collapse of the Bridge has deterred most of their former patrons. Tourists who would normally vacation at Pensacola Beach have chosen not to come because of the increased travel time. Pensacola residents who like to unwind at the Beach have similarly chosen not to patronize The Dock due to increased fuel costs and the fact that it now takes hours instead of minutes to visit the beach. “We are already at losses of more than $60,000 so far and we have had to lay off many of our employees,” says Justin Smith, General Manager of The Dock. “We have decided to close at 5 p.m. each day since the beach is absolutely a ghost town after that. No one is wanting to drive that far to the beach unless they are staying out here. Even in the off season The Dock always made a profit and was known for live entertainment,” says Smith. “We can’t afford to even have a DJ, let alone make payroll, pay utilities. etc. The businesses on the beach are in big trouble.”

Many of the firm’s clients have experienced huge economic losses, ranging from increased travel time for employees, managers, and patrons along with increased fuel supply and costs, lost profits, and lost business opportunities. Zarzaur’s lawsuits seeks reimbursement for all of the economic losses that the firm’s clients have incurred since the Bridge’s collapse.

Evan Malone, M.D. Joins Zarzaur Law, P.A.

Zarzaur Law, P.A. announces the addition of Evan Malone, M.D. to the firm. Dr. Malone joins the firm as the firm’s full time medical expert. Dr. Malone has been a part time medical consultant to the firm since 2012. The firm’s business has increased over the last several years and its concentration on medical malpractice cases has necessitated more time from Dr. Malone.

Dr. Malone, a Board Certified Internal Medicine Physician, will continue to bring experience, knowledge, and expertise as an essential part of the Zarzaur Law, P.A. team on a full time basis. His work with the firm not only provides expert medical advice to our lawyers and legal staff, he also advocates for public safety with Board Certified Civil Trial Lawyer Joe Zarzaur through Zarzaur Law’s ZTV video series on its YouTube Channel.

“Legal Graffiti” Foo Foo Style – Live Painting Event at Zarzaur Law Building to Take Place Nov. 8-10 in Downtown Pensacola

Zarzaur Law, P.A., a personal injury law firm based in Pensacola, Florida, presents a special event that will be a Foo Foo Fest edition of its well known “Legal Graffiti” event. This three day live painting event will attract locals and visitors that are in the Downtown Pensacola area for the Foo Foo Fest activities happening during the first two weeks in November. Visitors can watch three artists work on large canvases using a variety of paint, including spray paint, just like the traditional “Legal Graffiti” fundraiser events hosted by Zarzaur Law, P.A. during the monthly Gallery Nights.

The artists will paint on a 6ft x 6ft vinyl canvas at the corner of Palafox and Romana Streets right outside of the Zarzaur Law building in Downtown Pensacola. Each of the three artist, Jaime Shevant, Gabe Pellerin and Patrick Quintanilla, who were chosen through a submission process, will create one original piece using a variety of paint mediums and techniques.

“Being a part of this event brings me excitement to see where the art scene and Pensacola community as whole will go. Being able to expose the community to artist performing their passion may encourage others to take similar steps.” Said artist Gabe Pellerin.

Zarzaur Law’s “Legal Graffiti” Foo Foo Fest Style will take place Friday Nov. 8 and conclude on Sunday, Nov. 10 in Downtown Pensacola on the closing weekend of Foo Foo Fest. The completed paintings will be auctioned off as a fundraiser for Gulf Coast Kid’s House.

Zarzaur Law Accepting Applications for 2020 Triathlon Team.

Are you interested in being a member of the 2020 Zarzaur Law Triathlon team?

Zarzaur Law is looking to add new members from the local Pensacola area for our 2020 triathlon team – The Gavels. We’re looking for experienced triathletes who excel in representing Zarzaur Law, P.A.

 

 

 

 

 

 


What characteristics are we looking for?

1. Good ambassadors for endurance sports and the Zarzaur Law, P.A. firm.
2. Be community and philanthropic minded.
3. Filled with courage and motivation for others.
4. Possess the drive to be the best YOU can be.

The Details –

1. Men and women who are good ambassadors for endurance sports, that doesn’t only mean being on top steps of the podiums. While being fast is awesome and several of our athletes are incredibly fast, that, in and of itself, is not what it takes. The Zarzaur Law Tri Team is looking for triathletes that want to live and share lifestyles of health, fitness and truly love endurance sports. We’re looking for people who try to give a word of encouragement to others who are on the course, road, water or trail. And lastly, race to the absolute best of your ability on that day but, congratulate others even when things don’t go according to plan.

2. Philanthropic and community focused individuals. The Zarzaur Law Gavel Tri Team focuses extracurricular time on community events and charities. In addition to volunteering at races, The Gavel Team gives back to the community by supporting as a team or on an individual basis those organizations that promote safety, health and fitness. The Gavel Team has adopted Favor House and Gulf Coast Kid’s House as the two main charities to focus their support and represent. This includes some required events and fundraisers for these non-profit organizations each season.

It is extremely important that you have the time to dedicate to being a part of this team, the designated races, and the other events.
